Santus Fiduciaria provides a wide range of services to its clients, including administration, testamentary, and guarantee trusts. As well as rentier resident funds management and escrow contracts.
Through this model, Santus Fiduciaria will function as the administrator of all types of movable, immovable and/or intangible assets, and will be in charge of enforcing the obligations under the contract.
A management trust is beneficial in cases in which a third party is required to carry out efficient management and custody of the assets with the least risk possible. They are created for the convenience of the parties when there is a need to separate assets; or when there are joint investments; or in cases in which the person who makes the contribution of the assets (Trustor) feels limited or unable to manage his/her own assets directly.
In this instance, part or all of the assets of those people who explicitly wish to express their last will and testament in favor of a specific Trustee are transferred. This contract, which functions similarly to an ordinary will, will be executed upon the testator’s death; and it may be rectified or revoked at any time by the testator when deemed necessary.
This is the fiduciary contract in which a debtor transfers to a trustee one or more assets to guarantee a credit in favor of a creditor. The Guarantee Trust will explicitly establish the steps to be followed once the debt has been paid; or in the event that this is not fulfilled, it will execute the instructions to auction such assets given as collateral and thus obtain the necessary credit within a satisfactory agreement for the parties involved.
Contract for the Management of Rentier Resident Funds
Through this type of contract, all those people who are applying for residency in Costa Rica in the Rentier/Investor modality will be able to make the guarantee deposit required by the General Directorate of Immigration and Foreigners (Dirección General de Migración y Extranjería) in an account with Santus Fiduciaria.
This will allow them, as specified in the contract, to control their funds and the movements generated within the said account; at the same time, it assures the General Directorate of Immigration that the funds will remain in the country for the originally agreed term.
